General terms and conditions

 

Through placement of an order the customer declares to accept these terms and conditions.

He further agrees that all placed orders are legally binding, regardless of form used (orally, by telephone, written or through data transmission).

Any specifications as to the delivery time are given to the best of our knowledge and ability without assuming any liabilities.

In the case of a delayed delivery you will be informed by us through e-mail. The customer may cancel the order as long as it has not yet been sent out.

 

 

Delivery

 

We supply our products to customers worldwide. That includes digital downloads. We deliver as soon as possible and as long as stock lasts.

All products are subject to availability. We can not be held liable if a product is currently or permanently out of stock.

If an ordered item should be out of stock, the delivery of other products won't be concerned. The missing articles will be delivered to you as quickly as possible. We reserve the right to remove a product from your order, if that product is not available anymore.

In the case of unjustified refusal to accept delivery, asme music reserves the right to ban the customer and block his account on our website.

 

Delivery times:

within Switzerland: 2 - 3 days (Priority)

within Europe: 4 - 8 days (Economy)

worldwide: 7 - 15 days (Economy)

 

 

Shipping costs

 

If material goods are shipped (CDs, vinyl, etc.), shipping fees apply that are to be paid by the customer.This includes a fixed fee of CHF 2.00 for packaging and handling.

 

If we ship as express mail, additional costs apply that have to be paid by the customer. In case the parcel got returned or refused or the address is wrong, the customer has to pay the additional fees for the return.

 

Shipping fees are based on the amount ordered (weight) and will automatically be shown during the order process. We offer very inexpensive uninsured shipping of goods up to 250g. If you choose this option, lost or damaged parcels cannot be replaced, though. Registered shipping is possible and recommended. Additional fees for registered shipping are to be paid by the customer.

Downloads

 

There are no additional fees for orders that only consist of downloads (MP3, FLAC).

If you choose to pay via PayPal, your files will be immediately ready for download.

In case you prefer to pay via bank account transfer, you will be able to download your files after the payment has arrived on our bank account. You will receive a mail containing a download link and the download will also be available inside your customer account area on the asme music website.

 

 

Prices

 

We would like to offer our customers the best prices possible, but this means that prices may be subject to change. As a general principle, the price valid is the one named in the order confirmation, which corresponds with the price given at the date of the order placement on our website.

There is no discount for delayed delivery.

 

 

Changes in price and product range

 

We reserve the right to make changes in price, product range and technical modifications. All our offers are non-binding and subject to change. Erroneous information and typographical errors are excepted.

 

 

Product exchange & wrong delivery

 

Exchange or replacement because of dislike is not possible. Wrong delivery, transport damage and/or manufacturing errors are excluded. Our liability is limited solely to the replacement of the damaged item. All claims for rescission of contract or reduction of the purchase price are ruled out if a replacement of the damaged product can be delivered within an adequate period of time.

In the case of wrong delivery: any carrier of sound, picture or data can only be returned to us if the goods are undamaged and still in their original packaging. Manufacturing errors and wrong deliveries must be reported to asme music as quickly as possible.

 

 

Transport damage

 

Should the customer notice any damage to the packaging at the time of delivery, he must have a written confirmation of the damage by the transport operator or inform us within 48 hours in writing that he accepts the goods under reserve because of damaged packaging.

Any transport damages revealed after the unpacking of the received items have to be reported to us in writing immediately.

If it's not made possible for asme music to check or verify the defective goods or if the notice of defect was not submitted in written form at due date, absolutely no claims for free replacement can be made.

If the customer refuses to return the defective goods to us, or if asme music determines no damage at all or that the defect was caused by the customer himself, the replacement delivery will be charged to the customer.

 

 

Notice of defects

 

A reproach caused by receipt of defective goods must be submitted in writing within 10 days. 

 

 

Terms of payment

 

All delivery services require payment in advance. We reserve the right to process orders by invoice, cash on delivery, debit on credit card or bank account and partial or total payment in advance. If necessary, the customer will be informed about the method used.

Payment is considered as only accepted effectively if the amount due is irrevocably credited to our account.

Payment in stamps, cash or by cheque will not be accepted. Unless otherwise specified, every invoice falls due for payment without deduction in regard to the date of invoice.

 

 

Default of payment

 

If a note of demand for payment has to be issued for a second time, a compensation for causing us increased manual efforts will be charged to the deptor. We reserve the right to pass on any contracts of debt collection and the transmission of payment data of all kinds to the firm of our choice, entrusted by asme music with the collection of payment.

In the cases of default of payment, breach of contractual obligations or if asme music learns about a customer's impaired payment capability, we reserve the right to cancel the "sale by invoice" method of payment. We hold the right to withdraw from contract without granting a respite and without notice of refusal, as well as the right to demand compensation for non-fulfilment.

 

 

Retention of title

 

We retain the title to the goods delivered until we have received all ensuing payments. The customer is obligated to inform us about change of residence/business location as quickly as possible for as long as demands remain outstanding. Demands concern pending debts for already delivered goods or pending orders for yet undelievered items placed with us.

The customer is absolutely not authorized to neither pawn nor assign the goods as securtity for other creditors or overdue invoices. We have to be notified immediately about third party access to or demands of the products supplied under resevation of title.

 

 

Rights of use (Downloads incl.)

 

All items offered are intended for private, personal and non-commercial use. Any other use constitutes in a violation of the copyright laws. Any duplication for the purpose of sale, commercial hiring, public broadcasting or any distribution/transfer to third parties is strictly forbidden.

With the purchase of music content from our website, we grant solely the right of use to the customers, such as downloading a title, playing it on a computer and transfer it to CD or a portable music player.

 

Data privacy

 

All datas necessary for business purposes and processing orders will get stored and not passed on to others, except for the companies comissioned with billing and shipment of the ordered goods.

All data will be handled with the utmost care and treated confidentially.

 

 

Liability

 

To the extent permitted by law, asme music excludes or limits all liability for the delivered/sold products, Downloads inclusive.

 

 

Applicable law, court of jurisdiction

 

All legal relationships are subject to Swiss law. Exclusive place of jurisdiction for all disputes is Bern.
